JOINT REPORT OF AUTOMOBILE ACCIDENT
Use of the Joint report of Automobile Accident PDF form (the “Joint report”) created by the Groupement des assureurs automobiles, whose head office is located at 1981 McGill College Avenue, Suite 620, Montreal, Quebec, H3A 2Y1 (“GAA” or “we,” “us,” “our”), is subject to your acceptance of these terms of use (the “Terms of use”). By using the Joint report, you accept all of the conditions set out in these Terms of use.
1. Terms of use
You are authorized to use the Joint report on condition that you comply with the following obligations:
a) You alone are responsible for your use of the Joint report and the information, including personal informations, that you enter in it. We do not verify your information. Use of the Joint report requires entering personal information;
b) You consent to the collection of your personal information by the GAA, as such collection is necessary to create, compile, generate, and transmit the Joint report. Your personal information is collected electronically through the interactive PDF form;
c) Your personal information is accessible only to authorized GAA personnel whose knowledge of such information is necessary for the performance of their duties for the purposes stated above. Appropriate security measures are in place to ensure the confidentiality of personal information, as required by applicable law;
d) Your personal information is retained by the GAA and is not shared or disclosed to third parties, unless specifically required by law;
e) Your personal information is retained by the GAA until the earlier of: (1) the period necessary to fulfill the purposes for which it was collected or used, as set out in paragraph b); or (2) the withdrawal of your consent;
f) You may submit a written request to access your personal information, to request its rectification, or to withdraw your consent. Subject to the GAA still holding the personal information concerned, the GAA will provide access to such information and will proceed with its rectification or destruction, as applicable, in accordance with the law. Your request must be made in writing and addressed to the GAA’s person responsible for access to documents and the protection of personal information at the following contact details:

g) You are responsible for ensuring that the Joint report has been sent to the correct email addresses before leaving the scene of the accident;
h) You are responsible for ensuring that you have received the PDF version of the Joint report by email before leaving the scene of the accident;
i) If there are any technical problems, we strongly recommend that you obtain the other driver’s name and contact information before leaving the scene of the accident;
j) You are responsible for having access to an Internet connection or to wireless connectivity (e.g. 5G) in order to access our website and the Joint report and to be able to send the Joint report;
k) You undertake to refrain from (i) attempting to probe, examine or test the vulnerability of the Joint report; (ii) attempting to decrypt, decompile, disassemble, reverse engineer or otherwise ascertain the source code of the Joint report; or (iii) using the Joint report in a manner that is abusive or contrary to its purpose or documentation;
l) Your device must have adequately configured email software, failing which the features allowing the Joint reports to be sent by email will be inoperative. We are not responsible for the email transmission of Joint reports;
m) Joint reports will be sent only to the email addresses provided by the drivers. You agree to send the information entered in the Joint report to the other driver involved and to the insurers involved if one of the drivers selects this option following the accident. The conditions pertaining to the collection, use and disclosure of information by the insurers can be found in the contractual terms and conditions published by those insurers;
n) You acknowledge that sending your part of a Joint report to your insurer does not constitute the notice of claim required for the purposes of your insurance policy. You are responsible for taking separate steps directly with your insurer for that purpose, and;
o) You acknowledge that this Joint report was developed and will be applied in keeping with the applicable insurance legislation and regulations in Quebec. The Joint reports generated may not be compliant with the legislation and regulations that apply outside Quebec.
2. Intellectual Property
Any title to and right or interest in the Joint report and any trademark associated therewith remain our exclusive property or that of the third parties that granted us licenses or rights to use same. The Joint report is protected by copyright, trademark(s) and other domestic and foreign legislation governing intellectual property. This Joint report may not be marketed, reproduced, modified, distributed, sold, transferred, publicly presented, released to the public, used to create derivative works or made available to third parties other than for the purposes of allowing another driver involved in an accident to fill out a Joint report.
Reproduction of the Joint report is prohibited.
3. No warranty and limitation of liability
THE JOINT REPORT IS PROVIDED “AS IS” WITHOUT ANY EXPLICIT OR IMPLICIT REPRESENTATION OR WARRANTY WHATSOEVER.
IN PARTICULAR, BUT WITHOUT LIMITATION, WE DO NOT WARRANT OR MAKE ANY REPRESENTATIONS AS TO CONDITION, UNINTERRUPTED USE, MERCHANTABILITY, FITNESS FOR ANY PURPOSE OR NONINFRINGEMENT.
YOU HEREBY RELEASE AND DISCHARGE US FROM ANY AND ALL LIABILITY ASSOCIATED WITH YOUR USE OF THE JOINT REPORT.
WE DO NOT REPRESENT OR WARRANT THAT:
(A) THE USE OF THE SERVICES, NAMELY ACCESS TO OUR WEBSITE, ACCESS TO THE JOINT REPORT AND SENDING THE JOINT REPORT, WILL BE SECURE, UNINTERRUPTED OR FREE OF ERRORS OR WILL FUNCTION WITH ANY HARDWARE, SOFTWARE, SYSTEM OR DATA;
(B) THE SERVICES WILL MEET YOUR NEEDS OR EXPECTATIONS;
(C) THE SERVICES WILL BE FREE OF ERRORS OR THAT ANY ERRORS OR DEFECTS IN THE SERVICES WILL BE CORRECTED;
(D) THE WEBSITE AND THE TECHNOLOGICAL CAPABILITIES THAT MAKE THE SERVICES AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS;
(E) THE SERVICES ARE AVAILABLE AT ALL TIMES. THE SERVICES MAY BE SUBJECT TO LIMITATIONS, DELAYS AND OTHER PROBLEMS INHERENT IN THE USE OF THE INTERNET AND ELECTRONIC COMMUNICATIONS. WE SHALL NOT BE LIABLE FOR ANY DELAYS, DELIVERY FAILURES OR OTHER PROBLEMS RESULTING FROM SUCH PROBLEMS.
4. Reservations
The GAA Joint report is available to assist parties involved in an automobile accident. It is an easy-to-use tool that enables the parties concerned to identify themselves and facilitates reporting an accident to their respective insurers.
However, there are other tools available to you to report an accident to your insurer. Indeed, you can check if your insurer has a mobile application that can be used to fill out a Joint report, has published a Joint report on its website or offers other similar tools.
5. General Provisions
a) These Terms of use shall be governed by and interpreted in accordance with the laws of Quebec and Canada that apply to contracts destined for execution in Quebec between residents of Quebec. The courts of the judicial district of Montreal shall have exclusive jurisdiction to hear any litigation or dispute associated with these Terms of use.
b) If any provision of these Terms of use is declared null, illegal or unenforceable by a court of competent jurisdiction, that provision shall be severed from these Terms of use and the other provisions shall remain in full force.
c) These Terms of use constitute the entire agreement entered into between you and us regarding the Joint report, and they shall supersede and replace any written or verbal undertaking, contract, negotiation, discussion, comment, guarantee and arrangement between you and us.
d) We have the right to transfer our obligations under these Terms of use to any third party without obtaining your consent.
